The terms for using Lever.

This is Lever's Version 3 Terms and Conditions. Lever is operated by Lightstone Proprietary Limited, and these Terms govern your subscription to and use of the Service, alongside the End User License Agreement and Privacy Policy. They are pending final legal sign-off confirming the liability limitation language here is consistent with Lightstone's existing agent terms.

1. About these Terms

These Terms and Conditions ("Terms") govern your subscription to and use of the Lever service. Lever is operated by Lightstone Proprietary Limited ("Lightstone", "we", "us", or "our").

These Terms sit alongside our End User License Agreement (which governs the App as software) and our Privacy Policy (which governs how we handle personal information). Together, these three documents form the agreement between you and us.

2. Eligibility

To subscribe to Lever, you must:

  • Be at least 18 years of age
  • Be a licensed estate agent registered with the Estate Agency Affairs Board (EAAB), or otherwise be a qualified property professional entitled to process property and personal information under South African law
  • Have the legal capacity to enter into a binding contract

3. Your account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@leverapp.co.za if you suspect unauthorised access.

You may not share your account with any other person. Lever is licensed to individual agents and each subscription is for use by a single named user.

4. Subscription and billing

Pricing

Lever is available on a monthly auto-renewing subscription at R199 per month, unless otherwise stated on our website or in the App. Prices include VAT where applicable.

Billing

Your subscription is billed monthly in advance through our payment provider, Clerk. Payment is taken automatically on the same date each month.

Automatic renewal

Your subscription renews automatically each month unless you cancel before the next billing date.

Cancellation

You may cancel your subscription at any time through the App or your Lever account settings. On cancellation, your subscription remains active until the end of the current billing period. You will not be charged for subsequent months.

Refunds

Subscription fees are non-refundable. If you cancel mid-month, you will retain access to the Service until the end of the billing period but will not receive a refund for unused days. This does not affect your rights under the Consumer Protection Act 68 of 2008.

Price changes

We may change subscription prices from time to time. You will receive at least 30 days' notice before any price change takes effect. Continued use of the Service after a price change takes effect constitutes acceptance of the new price.

5. Free trial

Where we offer a free trial, the specific terms of the trial will be described at the point of sign-up. Unless you cancel before the trial ends, your subscription will convert to a paid subscription at the end of the trial period.

6. Your responsibilities as a licensed agent

Data protection

You are the Responsible Party (as defined in POPIA) for any personal information you process using Lever, including owner and buyer contact details, notes about clients, and other personal information you enter into or access through the App. You must have a lawful basis for processing this information under POPIA.

Lightstone has published guidance for estate agents on POPIA compliance, including a POPIA Estate Agent Handbook and infographics on the eight conditions for lawful processing. We recommend you familiarise yourself with this guidance at corporate.lightstone.co.za/property-popia.

Consumer Protection Act compliance

You must comply with the Consumer Protection Act 68 of 2008, including Section 69 restrictions on direct marketing. You are responsible for maintaining a compliant approach to opt-out registers and unsolicited communications when contacting property owners or prospects.

Professional standards

You must comply with the Estate Agency Affairs Act, the EAAB Code of Conduct, and all applicable industry regulations while using Lever.

AI outputs

You must independently verify all AI-generated content, including valuations and listing copy, before presenting it to clients or using it in any professional context. AI outputs are indicative only and do not constitute formal valuations under the Property Valuers Profession Act.

Accuracy of data

You are responsible for the accuracy of information you enter into Lever, including property details, condition notes, and client information.

7. Acceptable use

You agree not to:

  • Use Lever for any unlawful purpose
  • Use Lever to send unsolicited direct marketing in contravention of the Consumer Protection Act or POPIA
  • Attempt to extract, scrape, or bulk export data from the Service
  • Share your account with any other person
  • Use the Service in a way that could damage, disable, or impair the Service or interfere with any other user's access
  • Use the Service to store, transmit, or share illegal, defamatory, or offensive content

8. Third-party integrations

Lever integrates with third-party services, including Prop Data for listing publication and Lightstone Property for property data. Your use of these services through Lever may be subject to those providers' own terms. Lightstone is not responsible for the availability, accuracy, or performance of third-party services outside of its Lightstone Property division.

If your Prop Data or Lightstone Property access lapses or is terminated by the provider, related features in Lever will be unavailable.

9. Service availability

We aim to provide reliable access to the Service but do not guarantee uninterrupted availability. We may suspend or restrict access to the Service for maintenance, security, legal, or operational reasons. Where practical, we will provide advance notice of planned downtime.

10. Changes to the Service

We may add, modify, or remove features from time to time. Where a change materially reduces the functionality of the Service and you have prepaid for a subscription period, a pro-rata refund for the affected period will be provided on request.

11. Suspension and termination

You may cancel your subscription at any time as described in Section 4.

We may suspend or terminate your access to the Service if:

  • You breach these Terms, the EULA, or the Privacy Policy
  • Your subscription payment fails and is not corrected within 14 days
  • You use the Service in a manner that poses a legal, security, or reputational risk to Lightstone or its users
  • We are required to do so by law or regulator

Where we terminate for breach, no refund will be provided. Where we terminate for operational reasons unrelated to your conduct, we will provide a pro-rata refund of any prepaid fees.

12. Data on termination

On termination of your subscription, your account data will be retained for 90 days to allow you to reactivate. After 90 days, your data will be permanently deleted, except where retention is required by law.

You may export your data at any time before deletion through the App.

13. Intellectual property

All rights, title, and interest in the Service, including the App, content, and underlying technology, remain with Lightstone Proprietary Limited. Nothing in these Terms transfers any ownership rights to you.

Content you create using the Service (your listings, notes, photos, and other user-generated content) remains yours. By using the Service, you grant Lightstone a non-exclusive licence to store, process, and display this content solely for the purpose of providing the Service to you.

14. Warranty disclaimer and liability

The warranty disclaimer and limitation of liability set out in the EULA apply equally to the Service. Please refer to the EULA for full detail. Your rights under the Consumer Protection Act 68 of 2008 are not affected.

15. Dispute resolution

If a dispute arises between you and Lightstone regarding the Lever Service, we ask that you first contact support@leverapp.co.za and give us a reasonable opportunity to resolve the matter. If the dispute cannot be resolved informally, either party may refer the matter to mediation or to the courts of South Africa.

Nothing in this Section limits your right to lodge a complaint with the Information Regulator, the National Consumer Commission, or the Estate Agency Affairs Board.

16. Governing law

These Terms are governed by the laws of the Republic of South Africa.

17. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated in-app and by email. Continued use of the Service after a change constitutes acceptance of the updated Terms.
